TERMS OF SERVICE & LIABILITY WAIVER

MEDICAL DISCLAIMER:
PLEASE READ: Pitcher University, our Academy, and the Pitcher Strong program provide athletic and educational information only. We are not medical professionals. Pitching drills and strength training involve inherent risks of injury. Consult a physician before starting. If the Participant experiences sharp pain, stop immediately. By using these Services, you assume all risk of injury.
A. Introduction: This Agreement governs your use of services provided by Pitcher University. By purchasing any subscription or service, you agree to these terms.
B. Pricing & Content: Existing members as of April 13, 2026, are "grandfathered" into their current rate as long as the subscription remains active. Any lapse or cancellation of membership after April 13, 2026, will require re-enrollment at the then-current market rate. Access to our digital library is for the registered athlete only and may not be shared.
C. Eligibility: All purchases must be made by a parent/guardian (18+). You warrant you are the legal guardian of the participant.
D. Physical Activity: You agree that a parent/guardian will supervise all sessions. Form and movement quality must always come before adding weight or intensity.
E. Liability Waiver: I, the parent/guardian, acknowledge the risks of muscle strains, joint injuries, and falls. I hereby release and discharge Pitcher University, Nicole May, Kristina Thorson, and all contractors from any and all liability or claims for personal injury arising out of the use of these Services, including pitching analysis, clinics, and strength programming.
F. Arbitration: Disputes shall be resolved exclusively by binding arbitration (AAA) in Martinez, CA.
RETURN & CANCELLATION POLICY
Subscriptions: You may cancel your subscription at any time through your member portal. Because your membership provides immediate, 24/7 access to our proprietary digital library and exclusive training videos, all subscription fees are non-refundable once the billing cycle has begun.
Virtual Clinics: Must cancel at least 24 hours prior to the start of the clinic for a full refund.
Video Analysis & Pitching Plans: A full refund is available only before the video is submitted for review or the plan creation process has started. Once a video is submitted or work on a custom plan has begun, the service is non-refundable.

PRIVACY POLICY
Information We Collect: We collect the Parent’s name, billing info, and email. We collect the Athlete’s name, age, and video footage only when provided directly by the Parent for coaching purposes.
Website Analytics (Microsoft Clarity): We improve our site using Microsoft Clarity. By using our site, you agree that we and Microsoft can collect and use behavioral data (heatmaps and sessions) for site optimization and security. For more, visit the Microsoft Privacy Statement.
Children’s Privacy (COPPA): Our services are for minors only under parent supervision. We do not knowingly collect data directly from children under 13. All accounts must be managed by a parent (18+).
